David Chick (aka 'Spiderman'), who was arrested and remanded in custody yesterday after ending his 6-day protest on a crane overlooking Tower Bridge, appeared at Thames Magistrates' Court today on a charge of causing a public nuisance. He entered a plea of not guilty, thereby opting for a jury trial.
The maximum penalty for the offence is six months in prison and a £1,000 fine.

The fathers' rights campaigner who he staged a six-day crane-top vigil dressed as Spiderman at Tower Bridge has now brought the London Eye to a halt.
Protest: Spiderman closes the London Eye
David Chick gained access to the tourist attraction before 4am this morning by claiming to be a workman, according to a spokesman for pressure group Fathers 4 Justice.
He then climbed to the top of the 450-feet structure dressed as Spiderman in protest at being denied access to his four-year-old daughter.
London Eye shareholder British Airways said it did not know how Mr Chick evaded security but described the breach as "unacceptable".
A spokesman said: "We don't know how he gained access to the wheel. He obviously got past security somehow but it wasn't as straightforward as saying he was a maintenance man.
"It will be looked at as part of a full investigation by the London Eye Company and we are taking this matter very seriously. We have extremely stringent security measures in place and will be looking urgently at how he got past them. It's unacceptable."
Mr Chick has not seen his daughter since March 1, 2003, after his former partner denied him access - despite a court order allowing him two hours each fortnight.
Today, he said in a statement: "My protest has moved forward, and has had to move forward, because nothing has changed to right the wrongs of one parent blocking an ex-partner access to their children in defiance of a court order."
Mr Chick added he was not a "troublemaker or attention seeker" but was simply trying to maintain a normal father-daughter relationship. "The British justice system has completely failed my child and I," he said. "To those who have been inconvenienced by my protest, I apologise.
Police were called to the wheel, billed as the world's highest observational wheel, at 3.49am this morning.
The area has been cordoned off and the London Eye will remain closed while the father-of-one continues his protest.

A father's rights campaigner entered the grounds of British Queen's residence Buckingham Palace and gained access to a balcony Monday afternoon.
Metropolitan Police cordoned off the area as crowds built up to watch the one-man protest by Jason Hatch, 33, who was campaigning for greater custody rights for divorced or separated fathers.
Hatch, dressed as Batman, stood on a ledge to the right hand side of the main balcony at the front of the palace, unfurling a banner which read: "Super dads of fathers 4 justice -- Fighting for your rights to your kids", witnesses said.
"There's a man there, but it's a police matter. I'm not sure where he is but I can hear him shouting," a Buckingham Palace spokeswoman told the BBC.
The Queen was not at the palace as she is at Balmoral in Scotland, the spokeswoman added.
Matt O'Connor, spokesman for the Fathers 4 Justice group, said Hatch's protest was to highlight the court appearance of Patrick Davis, another member of the group who staged a flour-throwing protest in the House of Commons in May.
On Saturday, David Chick a member of the group dressed as Spiderman climbed to the top of the 137-meter London Eye wheel beside the River Thames.

for most of the day.
The following is a list of actions that have been taken this morning (Monday 2nd February 2004):

- Tyne Bridge, Newcastle is suffering major congestion as a result of action by Batman, Robin, Superman & Spiderman.
- A13 in London, we are unsure but think that it is probably been closed by Batman
- A40 in London, Superman has caused the closure of two lanes.
- A2 Kent, 2 people taking action, we are awaiting further details
- M4 London, again action being taken, we are awaiting reports.
Tremendous Paul Robinson was on the M4 and also got thrown off.
Darryl is on A40 and Graham is on the A13 keeping the police at bay.
Arrested: At Blackwall Tunnel was Matthaus Huber as well as Robin (I believe).

Four members of The civil rights pressure group Fathers 4 Justice have taken up their places on top of Tower Bridge in London
(built by Horace Jones in 1894 - the things you learn from tourist venues).
The 4 Men all dressed in Father Christmas outfits gained access to the roof of the bridge and have unfurled a banner reading Get Plucked Minister.
They were assisted by 16 fellow members creating a diversion in the walkways below.
More details as they emerge.
The Men intend to stay up on the Bridge until Christmas Day and are campaigning for equality and say that 1 in 4 children will not see their Fathers this Christmas.

This story was covered on ITV London at 18:15 pm saying the Crusaders went on the bridge in the afternoon.

FIVE protesting Santas were appearing in court today after a stunt which brought traffic chaos to Liverpool.
The men face charges of causing a dangerous obstruction of a highway.
The accused - all members of campaign group Fathers 4 Justice - allegedly climbed onto a footbridge on the Strand last Thursday while wearing Father Christmas outfits, forcing police to close the road.
All six lanes of The Strand were closed as emergency services attempted to coax the Santas down.
Appearing at Liverpool magistrates court were
Peter Michael Molloy, 33, of Hartsbourne Avenue, Childwall;
David James Humphrey, 30, of Manor Road, Crosby;
Stuart Peter Fisher, 38, of Dingle Lane, Dingle;

The charge of causing a dangerous obstruction of a highway carries a sentence of up to seven years.

Today members of Fathers4Justice targeted Portsmouth CAFCASS as part of the national campaign against CAFCASS.
Paul Summerfield was handed fines totalling £700 in Portsmouth magistrates court for painting their door purple.
Paul has always stated that he painted the door to protect his family and to highlight the disgraceful way that
CAFCASS are sending family court documents to the police so that the police are able to use them as evidence.
The demonstration lasted about 90 minutes, hundreds of leaflets were handed out to passers by.
CAFCASS manager Pam Merritt was invited to come out and explain their code of practice,
obviously she declined the invitation, the demonstration was peaceful and there were no arrests.

Why when within your own profession are there tidy policemen who have got divorced and struggle like other members of the public for some justice and sanity in the mad world of the £amily £aw So£icitor, £amily Courts & CSA do you add an indifference to the miscarriage of justice.
Surely Esti's dad is not getting a fair deal as a parent. Adding the general indifference of your force to the situation merely increases the unfair deal. That's not to say I think its a good idea to arrest people who feed ducks.
(Its actually bonkers to think this happened in Brecon - perhaps the Viz comic maybe!).

F4J chair Matt O'Connor has delivered an Open Letter to Lord Filkin (Constitutional Affairs Minister),

The Father had residency but it appears the children wanted to live with their mother and that has happened.
Compare this with the November case at
Heartbreak Hotel where the gender situation was reversed.
In that case, the Father nearly went to prison for a criminal offence, because he choose to support the child's wishes.
The Mother's Attitude To Contact is Hostile.
The Father has now not seen his children for two years. So much for two parent support of children..

Darryl a 21 year old Drama Student is making a Father's Protest.
He was given up by real mother and prevented from seeing his real father.
Although placed in foster care when 5 days old his foster parents subsequently split, and again, not allowed to see foster father.
The birth of his son is a typical teenage accidental pregnancy.
Currently the CAFCASS recommendation for Father Contact with Joshua, now 18 months is:
Seen the child eight times, half at cafcass, all supervised.
1 hour for Christmas on Christmas Eve.
There is a Final Hearing 18th Feb 2004 to gain parental responsibility and more regular contact.

The child on more than one occassion 'ran away' to the father.
The mother via a 'private judge's motion' sought for the child to be returned to her.
The child, who had advised his own solicitor, retreated to his bedroom and would not leave.

(28 Jan 2004) and it is clear that the court intended to deliver a public
message. The ruling confirms that our family justice system encourages
custodial parents to use the courts to shut the other parent (usually dad,
but sometimes mum) out of their child's life.

4th December 2003: Ministers call on CAFCASS Board to resign
The Minister for Children Margaret Hodge [Lab:Barking],
and the Secretary of State for Constitutional Affairs Lord Falconer, have called on the entire board of CAFCASS to resign.
The news comes in the wake of a highly critical report by a House Of Commons Select Committee inquiry in July 2003,
and a mounting tide of criticism and media scrutiny of CAFCASS and its operation.
In October, following the Commons report, Hodge had appointed Sir Clive Booth to review the CAFCASS board.
In the same week, Anthony Hewson resigned as Chairman of CAFCASS.
CAFCASS is the body responsible for advising the family courts in child custody disputes,
and is widely felt to be highly discriminatory against fathers.

WAR ON SECRECY IN THE ENGLISH FAMILY COURTS
UK ATTORNEY-GENERAL SEEKS TO IMPRISON DR MICHAEL J.PELLING

AN ACCOUNT OF DR PELLING'S TRIAL 8,9 FEBRUARY 2005
1. The trial commenced on 8 February 2005 in Court 3 Royal Courts of Justice (Lord Denning MR's old court) before Lord Justice Laws and Mr Justice Pitchford. The presiding judge originally allocated was Lord Justice Pill, mysteriously switched at the last minute to the most pro-Government pro-secrecy Lord Justice on the Bench. No satisfactory explanation for this change has been given by the Crown Office. Private Eye 1113 (20/8/04) reports how in August 2004 Laws LJ ruled that evidence obtained under torture can be used in British courts and states: "Laws' former colleagues at the Bar say he has never really shaken off the mantle of being senior Government treasury counsel; he has always been a believer in that old friend of secrecy, the public interest immunity certificate and he used them regularly...". Not the most promising start to a trial where a litigant in person is defending against the Attorney-General and the issue is secrecy of court judgments.
2. Dr Pelling had other reasons to object to Laws LJ sitting on his case. In 2000 Laws LJ on appeal had upheld a Divisional Court decision rejecting his application for Leave to take criminal contempt proceedings against His Honour Judge Goldstein for doing essentially what Dr Pelling is now accused of by the Attorney-General - publishing or using without leave of the court judgments in Family proceedings. The corrupt Goldstein had filched from Dr Pelling's Family proceedings court files at Bow County Court documents which he sought to use in his defence to a Judicial Review brought against him by Dr Pelling for refusing to allow him to act as a McKenzie Friend (see R v. Bow County Court ex parte Pelling [1999] 1WLR 1807, [1999] 2FLR 1126, CA). Naturally Laws LJ protected his fellow judge and when Dr Pelling gave a reasoned speech pointing out that not all might be as holy and righteous in the ranks of the English Judiciary as some like to think, Laws LJ condemned this as a "tirade of abuse against the English Judiciary". You can read an account in CONTACT 5, but the point here is that Laws LJ had manifested bias on that occasion.
3. Dr Pelling tangled with Laws again in January 2001 when he refused Leave to Appeal against the Divisional Court's decision in R v. Bow County Court (No.2) [2001] UKHRR 165 DC which declined to quash Civil Procedure Practice Direction 39PD §1.5(2) which permits and initially requires landlord and tenant possession cases for non-payment of rent to be heard in secret in the County Courts. This was one of the Open Justice Campaign test cases. The typical possession case continues to be heard in total secrecy, in violation of the fundamental Common Law rule of Open Justice. Thus Laws LJ certainly has no respect for this aspect of the Common Law and cannot be considered a fit and fair judge to try a case where court secrecy is the issue.
4. On these grounds Dr Pelling asked Laws LJ to stand down from his case, but he refused to recuse himself and the case went ahead.
5. The Attorney-General then raised a preliminary issue of whether the case should be heard in camera at least to the extent of preventing any reference to the Children Act Judgment in issue published in CONTACT 5 and preventing any reference in open court to the Websites where CONTACT 5 and the Judgment are freely available. Dr Pelling countered that such restriction was futile since the Judgment was well and truly in the public domain and anyone could find it in a few minutes searching on the Internet. He further cross-applied for the case to be fully public like any criminal trial, where all the evidence must be communicated publicly so that people can see what the case is against the accused and see that justice is done. Dr Pelling insisted that the A-G's affidavit evidence must be read out in open court before he cross-examined and that the sundry exhibits must at least be available for public inspection. This was his, and the public's, fundamental right at Common Law in a criminal trial [criminal contempt, which is the charge against Dr Pelling can equally be prosecuted in the ordinary criminal courts by way of indictment or information]. It was also a right under Article 10 ECHR. Article 10(1) is obviously engaged but the A-G refused to state his case for an exception under Article 10(2) despite his duty to do so.
6. This took up most of the day and concluded with the Court making the Order that the A-G had drafted, preventing mention in open court of the details of the Judgment and of the Website addresses, and going on to make an order under s.11 Contempt of Court Act 1981 forbidding publication of any of this information in connection with the proceedings. Fortunately, the Order only referred to Website addresses, not Email addresses, so the next morning 9 February Dr Pelling began by announcing in open court that the Judgment and CONTACT 5 are believed to be available on request from paulmw@ji-net.com in Thailand. Laws LJ then got very hot and accused Dr Pelling of contempt of court, until he was forced to admit that there is a difference between a website address and an email address. The Court then amended its Order to cover Email addresses too BUT note that s.11 Orders cannot prohibit publication of something already stated in open court (only things that have been withheld from the public in the proceedings), so anyone can lawfully report that that the Children Act Judgment in issue is available on request from Paul Warren at paulmw@ji-net.com.
7. As Dr Pelling observed, the Order is defective for another reason - it fails to state under which limb of CPR 39PD §2.3 it was being made - which one of the listed categories (a) - (g). Arguably this is fatal. But the Court refused to state the basis of its Order! The Court also refused to allow Dr Pelling to address Article 10(2), as obviously his Article 10(1) point had failed in the Court's view, and even refused to say whether they considered Article 10(1) was engaged! On the cross-application for full public communication of the Prosecution evidence, the Court ruled that was dismissed so far as conflicting with its s.11 Order, but otherwise the matter would be kept under review as the case progressed - obviously utterly unsatisfactory from the public's point of view who would not know when or if at all they would ever get to hear or inspect the evidence against Dr Pelling.
8. The A-G's counsel, Mr Andrew Caldecott QC, then gave his opening speech and craftily advanced a very different case from the one originally made in his Particulars of Claim against Dr Pelling. Dr Pelling was originally charged with "serious interference with the administration of justice". Now the A-G was saying that this did not have to be proved at all and that the mere fact of the publication was enough since the court sitting in chambers carried an "implied prohibition" against publication, and so publication must be a contempt. Essentially he was now arguing for a special privacy right for children which they have for their protection, which Dr Pelling was said to have infringed, but that is not the same as interfering with the administration of justice, as the classic case of Scott v. Scott [1913] AC 417 has long shewn. Dr Pelling's Skeleton said that the alleged offence of criminal contempt does not exist at all except in Wardship (and that it is a myth created by the Family Division in order to justify and bolster secrecy). Even if it did exist he had further serious defences. The arguments are difficult and cannot be gone into further here. Mr Caldecott QC finished his speech at 1 pm and the Court adjourned to 2 pm.
9. However one looks at it, Dr Pelling had pertinent questions to ask of the A-G's 2 witnesses and was naturally expecting as of right to cross-examine them at 2 pm. He was amazed to find that the Court considered he had to apply for leave to cross-examine! Under protest he formally requested Leave. On questioning by Lord Justice Laws he declined to disclose in advance his lines of cross-examination - why should the A-G have that advantage? In a normal criminal trial (unless of course the defendant pleads guilty) it goes without question that one has a right to confront and cross-examine one's accusers. Dr Pelling claimed the right at Common Law to cross-examine the witnesses against him and stated that the purpose was to elicit facts which would help the defence case, but declined to give any further information.
10. The Court retired to consider and then returned and ruled that Dr Pelling would not be allowed to cross-examine the Attorney-General's witnesses. Dr Pelling then stated he would not take any further part in the case. On his Solicitor's prompting he asked for a 1/2 hour adjournment to confer, which was granted [Dr Pelling has Criminal Legal Aid but was appearing as his own advocate, with his excellent Solicitors Kingsley Napley responsible for the conduct of litigation. This procedure is permitted under Criminal Legal Aid]. However, after discussion, and ascertaining also the views of members of the public present, Dr Pelling was of the opinion that it would only be more damaging to continue in an unfair trial which had turned into a charade of justice. So he declined to take further part and merely stated he would attend for the Court's sentence and they would not need to send the Tipstaff to arrest him.
11. The Court has reserved its Judgment and meanwhile Dr Pelling prepares his applications for Leave to Appeal to the House of Lords against the above adverse decisions. The result of the trial will be a conviction on Prosecution evidence none of which was ever communicated to the public and with none of the Prosecution's case permitted to be tested in cross-examination.

In the case of LEVIS v WEBB
I made my application (CM03P00775) to ask the court for the previous order to be enforced.
I am happy with the previous order as it grants me contact with my children.
Yet it is now three and a half years since I have had contact with my daughter, Emma, aged 15 and
one and a half years since I have had contact with my son, Paul, aged 10.
It has been suggested that my children do not want to see me but I do not accept this.
Ever since our relationship ended my ex-wife has been able to reduce the contact I have had with my children
whilst maintaining the impression that she has no problem with it.
In the five years since we split up I have not had one photograph, even school photographs,
or any information regarding my children from my ex-wife which makes it obvious to anyone that
she does not want me involved in their lives.
This alienation has also spread to the rest of my family - their grandparents, aunt and uncle and cousins.
Children would want to see their grandparents unless the emotional pressure being put on them was
strong enough to overcome even that natural desire.
This emotional abuse is a classic case of Parental Alienation Syndrome (PAS)
which the court must come across every day yet appears unable or unwilling to do anything about.

Fathers put Children's Minister in chains

TWO Fathers 4 Justice campaigners burst into a conference of several hundred judges and lawyers yesterday and handcuffed Margaret Hodge, the Minister for Children.
The minister was left standing chained to one of the men for ten minutes while police were summoned to cut off the handcuffs. The other protester, who had intended to join himself to her other hand, was tackled by conference participants including Dominic Grieve, the Shadow Attorney-General, and Janet Paraskeva, chief executive of the Law Society.
The protest by Jolly Stanesby and Jason Hatch who recently scaled Buckingham Palace dressed as Batman happened despite extra security arranged by the Law Society, the organisers of the conference in Manchester on family law.
The men, who had dressed in suits to look like lawyers attending the conference, declared that they were making a citizens arrest as they descended on the minister. Mr Stanesby was arrested for assault and unlawful detention. However, Mrs Hodge is understood not to wish charges to be preferred.
Last night Mr Stanesby was released without charge on police bail by Greater Manchester Police after being held for questioning.
Mrs Hodge, who was preparing to answer questions, after her speech, remained composed throughout the episode. Lord Justice Thorpe, a senior family judge who was scheduled to speak shortly after Mrs Hodge, said that he was surprised at the lack of security for a government minister. I dont see why she should not have had a couple of plain clothes policemen with her.
When you see something as crude and offensive as that, it just emphasises that it destroys the climate necessary in which there can be a reasonably detached debate, he said.
Fathers rights campaigner cuffs himself to Children's Minister

A Fathers 4 Justice campaigner handcuffed himself to Margaret Hodge, the Minister for Children at a family law conference in Manchester today.
Two campaigners approached Mrs Hodge as she was giving a keynote speech and put on the handcuffs at about 10.30am, claiming that they were making a citizen's arrest.
Fathers 4 Justice said that the two campaigners were Jason Hatch, who scaled Buckingham Palace dressed as Batman earlier this year, and Jonathan 'Jolly' Stanesby.
Police officers arrived at 10.50am, and the handcuffs were opened. A man was arrested.
A Department for Education spokeswoman said: "The matter is being dealt with by the police and she is going ahead with her speech as planned."
A Greater Manchester Police spokesman said: "Police were called to the Lowry Hotel after a man is believed to have entered a meeting being held in a function room and handcuffed himself to a government minister.
"Officers arrived at the hotel and the minister, who was attending the meeting, was freed from the handcuffs. She was unharmed and a man has been arrested in connection with the incident. The man involved is believed to have been representing Fathers 4 Justice."
It is believed that a third man tried to join Mr Stanesby and Mr Hatch on stage, but was wrestled to the floor by lawyers sitting in the front row.
Mr Hatch later claimed that security around the minister had been lax. He said he and Mr Stanesby booked a room in the hotel the previous week, and last night they inspected the conference room where Mrs Hodge was handcuffed today.
Mr Hatch, from Cheltenham, and Mr Stanesby, 38, from Manor Close, Ivybridge, Devon, strolled into the conference room posing as lawyers taking part in the meeting, he said.
"There was no police outside the conference room, only security guards. We walked straight up to Mrs Hodge, who was sat at a table and I said: Youre under arrest. Jolly handcuffed her and I tried to do the same."
Hatch said they then let off smoke flares in the conference room before fire crews were called to cut the minister loose from the plastic coated police issue handcuffs.
Asked about the protest, Hatch said: "This is the Fathers 4 Justice response to the Home Office report called Making Contact Work. We believe in non-violent direct action. This is our message to get the Government to listen and let them know they cannot ignore us any longer."
Fathers 4 Justice campaigner Matt OConnor confirmed that Jonathan "Jolly" Stanesby, a registered childminder, was arrested following the stunt. Mr OConnor added: "This was the first in a series of planned protests in the run up to Christmas. Most of the protests will involve Father Christmas in a whole range of scenarios."
Mrs Hodge had another run-in with Fathers 4 Justice a week ago. Police had to hold back protesters when she arrived to deliver a speech near Bootle, Merseyside last Friday.
In an interview with Monday's Independent she said: "I did a speech and blasted Fathers 4 Justice came. They were there with loud-hailers and so on. I talked to two of them because I thought it would calm them down."
Mrs Hodge is sympathetic to the fathers' plight. But she has refused to give in to their demand that fathers and mothers share 50 per cent custody after a break-up, insisting the child's interests always be put first.
"Of course fathers miss their kids," she said. "Divorce and separation is horrible for everybody. But the idea that the state can sort out entrenched animosity and bitterness in a relationship, I think is stretching it a bit far."
She also criticised Sir Bob Geldof, who has become a frontman for the fathers' movement. "He believes the courts are biased. He believes everybody is institutionally against dads. It is not true. You can't look to the state to resolve those domestic issues," she said.
The Law Society condemned todays Fathers 4 Justice stunt. Chief executive Janet Paraskeva, who was sitting next to Mrs Hodge when she was handcuffed, said: "The Law Society is appalled by the behaviour of Fathers 4 Justice. It diminishes the debate and in no way serves the interests of children or their parents."
Fathers 4 Justice have rarely been out of the headlines this year with a series of high-profile stunts.
In September, Mr Hatch staged a five-hour protest on a ledge at Buckingham Palace. Dressed as Batman, Hatch, from Cheltenham, Gloucestershire, used a ladder to gain access to the Royal household. He later wrote to the Queen to apologise. He has been bailed by police without charge.
In May, F4J campaigners Ron Davis, 48, and Guy Harrison, 36, brought Prime Ministers Questions to a halt with the infamous "funpowder plot". Harrison hurled a condom full of purple glitter and flour at Tony Blair as Davis held a poster upside down and chanted slogans. Davis was given a two-year conditional discharge, while Harrison was fined £600.
In February, four F4J protesters - including Hatch - dressed up as superheroes and scaled the Clifton Suspension Bridge in Bristol, causing traffic chaos. They were later found guilty of public order offences.
In January, a F4J protester climbed the gantry of the Tamar bridge, near Plymouth. He was joined by 36-year-old Jayne Woodman, a human resources manager from Swansea, who was the first woman to protest on behalf of the group. The demonstration caused long tailbacks on both the Devon and Cornwall approaches to the bridge when the pair blocked the carriageway with two cars.
F4J staged its first demonstration on December 17, 2002 - a raid on the offices of the Lord Chancellors Department by 200 Father Christmases campaigning to "Save Father Christmas".

Flushed with the success of the 'Santa' Demo and sit-in at the Lord Chancellor's Department on 17th December 2002,
F4J staged its second major protest in the capital, when a group of fathers led by Matt O'Connor (all in Elvis costumes)
erected a specially-commissioned 20ft inflatable heart outside the Royal Courts of Justice - the 'Heartbreak Hotel'.
The protest attracted considerable media interest, and was covered by The Times ( read it here).
Matt O'Connor also appeared on BBC NEWS 24 television the following morning (15th Feb 2003).
Rosie Winterton, Minister for the Family, (see Domestic Violence and Family Law Act Amendment 2001)
was also invited on the programme,
but was unwilling to share the platform with F4J and insisted on being interviewed after Matt so that she could have the final say.
Ms Winterton's refusal to engage in direct public discussion on the issues at the heart of F4J is set to backfire on her though,
as F4J's campaigning machine sets her in its merciless gaze...

'Hot Cross Bunny' protest at country house hotel in Somerset
F4J bunnies paid a visit to the country house hotel in Somerset owned by Family Court judge Mrs Justice Bracewell.
Bemused guests at the hotel looked on over breakfast as the Hot Cross Bunnies hopped around on the hotel lawns.
The Easter Sunday protest brought increased national media coverage for F4J, with national chair Matt O'Connor interviewed live
from the scene on Radio 5 Live, then on BBC Radio Scotland the following day, and on Woman's Hour on Radio 4 on the 28th of April.
All this in addition to local radio coverage.
